RESIDENT LEADERS THANK CITY, NOPD FOR ENFORCING NOISE ORDINANCE…EVEN THOUGH BAR INTERESTS TRUMP POLICE WORK

Resident leaders from several city neighborhoods thanked the City of New Orleans and the New Orleans Police Department for taking a bar to court to enforce the noise ordinance, even though the purported violator was found “not guilty” in Municipal Court.
The case involved Police Lieutenant Mike Field who on December 8, 2011 could not hear his own police radio on Bourbon Street due to the excessive noise emanating from Bourbon LIVE. The citation issued by Lieutenant Field indicates the bar was violating CNOMC 66-203 (5) which prohibits bars from pointing loud speakers into the street to drive in business.

The bar was found not guilty of the violation because the officer had not taken any measurement of the noise levels at the bar, even though the officer said the volume was so loud he could not hear his police radio while standing in the street in front of the club.
“We’re disappointed that a bar and its commercial interests have trumped the police and police work,” said Cheron Brylski, www.HearTheNOLAMusic.com.
“This case shows that we can address the excessive noise issue with good enforcement,” said Meg Lousteau, representing Vieux Carre Property Owners Residents and Associates. “Clearly, the issue of how noise is monitored and who is responsible for doing that is relevant to the discussion.”
Last week, an expert on excessive noise, Arno Bommer, said his studies had confirmed dangerous noise levels in New Orleans French Quarter and other neighborhoods. Neighborhood leaders said they are working with Councilmember Kristin Palmer to strengthen the noise ordinance, improve monitoring, and other quality of life enforcements.
